Terms of service
1. Operator and scope
Exiria is operated by Exiria Games spółka z ograniczoną odpowiedzialnością. KRS 0001255280 · NIP 9512652549. Sąd Rejonowy dla m.st. Warszawy w Warszawie, XIII Wydział Gospodarczy Krajowego Rejestru Sądowego. Share capital: PLN 15,000. Contact: admin@exiriagames.com. These terms cover the informational website and, where you are directly invited, the test account and closed browser-game tests.
2. The current stage
The game is in closed testing before beta. There is no announced beta or launch date. Its visual presentation, functionality and availability are provisional and may change. Illustrations on this website are illustrative, not screenshots or a promise of gameplay content.
Testing is voluntary, free of charge and unpaid. There are no real-money purchases, subscriptions or paid invitations at this stage. Any test balances or items have no monetary value, cannot be redeemed for money and do not guarantee benefits in a later version.
3. Eligibility and joining
Testers must be at least 18 and personally known to the creators. Access is available only through a direct, free, personal invitation from us. An invitation includes the applicable private testing and confidentiality rules. Before access is activated, you must receive and expressly accept both those rules and these terms. Merely reading this website does not enrol you in testing or bind you to private confidentiality rules.
Invitations and accounts must not be sold, transferred or shared. Obtaining a link, registering with an identity provider or knowing another tester does not itself authorise access. We do not offer applications to join this circle.
4. Technical requirements and permitted use
The website needs an internet connection and a current browser with HTML and CSS support; it does not require JavaScript. The separate game needs a compatible current browser with JavaScript, WebGL and WebSocket support and necessary account cookies enabled. Test-specific compatibility requirements are supplied with the invitation. You bear your ordinary internet and device costs.
Protect your account and report suspected misuse. Do not bypass access controls, impersonate others, share credentials, disrupt the service or supply unlawful content. Report faults privately; do not exploit them or test other people’s accounts. Nothing here restricts rights that cannot lawfully be restricted.
5. Test changes, outages and resets
We may interrupt tests, change test features or reset progress, resources and test items where necessary to investigate faults, adjust balance, change data structures, protect the service or move between test stages. Test progress is not guaranteed to carry into beta or release. We give advance notice of planned material disruptions where reasonably possible; urgent security fixes or unplanned failures may require immediate action.
A reset of test progress is distinct from closing an account and from erasing personal data.
6. Leaving, suspension and account closure
You may leave testing and ask to close your account at any time, without a fee, by writing to admin@exiriagames.com.
We may suspend or end access when tests end, when eligibility is absent, when these terms or accepted testing rules are breached, or where technical or security needs require it.
Closure stops access. Personal data is then handled under the privacy policy; closure does not automatically erase records that must lawfully be retained. See the account and data deletion instructions.
7. Complaints and responsibility
Send complaints to admin@exiriagames.com. Describe the issue, when it occurred and the response you seek, and give us a way to reply. Do not send passwords or login tokens. We reply to consumer complaints on a durable medium, normally email, within 14 calendar days where this period is required by applicable law. Any more favourable mandatory rule prevails.
Testing may contain errors, but we do not exclude mandatory consumer rights, remedies, liability for intentional wrongdoing or other liability that cannot lawfully be excluded.
8. Changes to these terms
We may update these terms where reasonably necessary because of changes to the test, security, technical requirements, provider requirements or applicable law. Existing testers will be informed clearly of material changes before they take effect where required by law or reasonably practicable.
If a change materially and negatively affects access to or use of a digital service, mandatory information and termination rights remain available. Where renewed acceptance is required, we will ask you to accept the updated terms before continuing the test.
9. Law, language and document access
Polish law applies without depriving consumers of mandatory protections applicable in their country of habitual residence. Courts have jurisdiction under the applicable law; these terms impose neither compulsory arbitration nor an exclusive Warsaw court on consumers. English and Polish versions describe the same rules; no language clause limits mandatory rights. Private test conditions may supplement these terms only where disclosed and accepted, and may not remove mandatory protections.
